Introduction
Hailed as a “classic Chinese civil law textbook,” this book has won the First Prize for Excellent Legal Textbooks in General Higher Education and the Second Prize for National Excellent Teaching Achievements. Drawing on extensive materials, solid evidence, rigorous argumentation, and a unique style, it has been beloved by students for many years. Since the revised third edition was published in 2000, no new edition has been released. By the time Professor Zhang Junhao passed away in 2022, the book had been out of print for years and became extremely difficult to obtain. This time, Professor Liu Xinwen and Professor Yao Xinhua, the original deputy editors-in-chief, have been invited to lead the rearrangement and proofreading. This effort aims to meet the expectations of numerous readers and continue the legacy of this classic work, which can be regarded as a milestone in Chinese civil law education. The book is divided into two major parts: Introduction and Main Text, comprising seven volumes: Introduction, General Principles, Theory of Property Rights, Theory of Intellectual Property Rights, General Theory of Obligations, Specific Theories of Obligations, and Theory of Inheritance. It provides detailed commentary on the perspectives of traditional Chinese civil law textbooks, the provisions of China’s civil laws, regulations, and judicial interpretations, tracing their origins and conducting comprehensive comparisons.
